Effective from 30 October 2026.
§ 1. Service provider
The atlanticmoto.pl service (the "Service") is run by Marcin Felczak, running a sole proprietorship under the AtlanticMOTO brand, ul. Potażowa 45, 02-400 Warszawa, Poland, tax ID (NIP) 5361810183, REGON 360302950 (the "Provider"). Contact: biuro@atlanticmoto.pl, phone +48 511 481 415.
These terms are terms of electronic services under the Polish Act of 18 July 2002 on providing services by electronic means.
§ 2. Services
The Provider offers in the Service, free of charge:
- browsing and searching vehicles offered at auctions in the USA and Canada (including Copart and IAAI) and the archive of finished auctions,
- a calculator of estimated import costs,
- a user account with the option to watch auctions,
- a newsletter with offers and advice (for those who consented),
- guides, lists of recommended cars and contact options (phone, WhatsApp, e-mail, chat).
The agreement for using the Service without an account is concluded when you open the website and ends when you leave it. The account and newsletter agreements are concluded for an indefinite period.
§ 3. Technical requirements
You need a device with internet access and an up-to-date browser with JavaScript and cookies enabled; for the account and newsletter, also an e-mail address.
§ 4. Account
- You create an account by providing true data in the registration form or by signing in with Google. The account is free of charge.
- Your password is confidential. Do not share it.
- You may delete your account and terminate the agreement at any time by writing to biuro@atlanticmoto.pl.
- The Provider may block or delete an account used unlawfully or against these terms, after a prior request to stop the violation, and without such a request in serious cases (e.g. an attack on the Service).
§ 5. Auctions, prices and vehicle purchase
- Vehicle data, photos, bids and auction dates come from auction houses and an external data provider. The Provider does not own the vehicles or run the auctions and does not guarantee that the data is complete and up to date. We check the vehicle before bidding on your order.
- Amounts in PLN, calculator results and cost estimates are indicative (they depend on exchange rates, auction fees and transport rates) and are not an offer within the meaning of Art. 66 of the Polish Civil Code.
- The "Bid" buttons and similar are used to contact our advisor. Using the Service does not mean concluding a purchase agreement or a bidding order.
- Bidding, purchase, transport and customs clearance are carried out under a separate agreement (order) concluded with the Provider individually, which sets out the fee, costs, payment terms and liability.
§ 6. Rules of use
It is prohibited to provide unlawful content, to disrupt the Service and to download data from the Service in bulk by automated means (e.g. bots and scripts) without the Provider's consent.
§ 7. Complaints
You can submit complaints about the Service by e-mail to biuro@atlanticmoto.pl or by post to the Provider's address. Describe the problem and give an address for the reply. We will reply within 14 days.
Consumers may use out-of-court complaint procedures, e.g. the help of a municipal consumer ombudsman or the Trade Inspection.
§ 8. Liability
The Provider takes care of the continuous operation of the Service but may introduce technical breaks. The Provider is not liable for data from auction houses and data providers or for external websites linked from the Service. This section does not limit consumer rights under the law.
§ 9. Personal data
Personal data processing and cookies are described in the Privacy policy.
§ 10. Final provisions
- The Provider may change these terms for important reasons (e.g. changes in law or in the Service). Account holders are informed by e-mail at least 14 days before changes take effect. If you do not accept them, you may delete your account.
- Polish law applies to matters not covered here. This choice of law does not deprive consumers of the protection granted by the law of their country.
- These terms are effective from 30 October 2026.
